Terms & Conditions

The terms on which Elite Container Supply sells, modifies, delivers and exports shipping containers. Please read them carefully before placing an order.

These Terms apply to elitecontainerssupply.com and to all quotes, orders and supply agreements with Elite Container Supply.

1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of the website elitecontainerssupply.com and any purchase of goods or services from Elite Container Supply ("ECS", "we", "us" or "our").

By browsing this website, requesting a quote, or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use this website or place an order with us.

If you are entering into these Terms on behalf of a company or other legal entity, you warrant that you have authority to bind that entity.

3. Definitions

  • "Container" means any shipping container, cabin, flat pack unit, accessory or modified unit supplied by us.
  • "Goods" means the Containers and any related items supplied under an Order.
  • "Order" means your request to purchase Goods, whether placed online, by email, or via WhatsApp.
  • "Quote" means a written price we provide for specified Goods and services.
  • "Delivery Point" means the address or port nominated by you for delivery.
  • "Consumer" has the meaning given in the Australian Consumer Law.

4. Eligibility & Accounts

You must be at least 18 years old and legally capable of entering into binding contracts to purchase from us.

If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. You must notify us immediately of any unauthorised use. We may suspend or close accounts used in breach of these Terms.

5. Products & Descriptions

We take reasonable care to describe our Containers accurately, including dimensions, condition and specifications.

However, please note:

  • Shipping containers are industrial goods. Used units will show surface rust, dents, scratches, patch repairs, previous paint markings and general cosmetic wear consistent with their age and grade.
  • Photographs on our website are representative of the grade and type, and are not photographs of the specific unit you will receive unless expressly stated.
  • Container colours vary and cannot be guaranteed unless specified in writing and agreed in your Quote.
  • Stated dimensions are nominal industry standards and are subject to normal manufacturing tolerances.
Inspection is encouraged. Where practical, we welcome you to inspect a Container at our Botany yard by appointment before purchase.

6. Container Grading

Containers are supplied under the following general grades. The grade applicable to your Order will be stated in your Quote or product listing.

Cargo Worthy (CW)Structurally sound and certified suitable for international shipping. Cosmetic wear expected.
Wind & Water Tight (WWT)Sealed against wind and water; suitable for storage. Not certified for sea cargo. Visible wear, rust and repairs.
As-IsSold in current condition, faults included, as specifically described. No condition guarantee beyond that description.

Where a Container is sold as Wind & Water Tight, that certification relates to the sealing of the unit and does not warrant cosmetic appearance or suitability for sea freight.

7. Quotes & Pricing

  • Unless stated otherwise, a Quote is valid for fourteen (14) days from its date of issue.
  • Prices are quoted in Australian Dollars (AUD) unless expressly stated in another currency.
  • Prices for domestic supply are inclusive of GST where applicable. Export sales may be GST-free where the relevant conditions are met.
  • Unless a Quote states that delivery is included, prices are ex-yard, Botany NSW, and delivery, freight, craneage and export charges are additional.
  • Container prices are affected by global steel, freight and currency markets and may change without notice until an Order is accepted and a deposit received.

We make every effort to ensure pricing on our website is accurate. If a pricing or description error is discovered after you place an Order, we will contact you and you may confirm the Order at the corrected price or cancel it for a full refund of amounts paid.

8. Orders & Acceptance

Your Order is an offer to purchase. No contract is formed until we accept your Order by written confirmation, invoice, or by dispatching the Goods — whichever occurs first.

We may decline or cancel an Order at our discretion, including where:

  • The Goods are unavailable or stock has been sold;
  • A pricing, description or availability error has occurred;
  • Payment cannot be verified or is suspected to be fraudulent;
  • The Delivery Point is unsuitable or unsafe;
  • Supply would breach any export control, sanctions or other legal requirement.

Where we cancel an Order, we will refund any amounts you have paid for that Order.

9. Payment & Deposits

  • Full payment, or a deposit as specified in your Quote, is required before Goods are reserved, released, modified or dispatched.
  • A deposit is non-refundable where you cancel an Order after we have reserved stock, commenced modification work, or booked freight — except where you have rights under the Australian Consumer Law.
  • Title in the Goods does not pass to you until payment has been received in full and cleared.
  • We accept the payment methods displayed at checkout or stated on your invoice. Bank transfer payments must quote your invoice number.
  • Overdue amounts may attract interest and reasonable recovery costs.
Storage. If Goods are not collected or accepted for delivery within fourteen (14) days of being made available, we may charge reasonable storage fees.

10. Title & Risk

Title in the Goods remains with ECS until we have received payment in full and cleared funds.

Risk in the Goods passes to you at the earlier of:

  • the time the Goods are loaded onto a vehicle at our yard for collection by you or your nominated carrier; or
  • the time the Goods are delivered to the Delivery Point; or
  • for export Orders, the point specified by the agreed Incoterm (see clause 12).

You are responsible for insuring the Goods from the moment risk passes to you.

11. Delivery & Site Access

Delivery timeframes are estimates only and are not guaranteed. We are not liable for loss arising from delivery delays, including delays caused by transport operators, weather, port congestion or traffic.

It is your responsibility to ensure that the Delivery Point is safe, legal and accessible. This includes:

  • Clear, level and stable ground capable of bearing the weight of the Container and the delivery vehicle;
  • Sufficient overhead clearance (free of power lines, branches and structures) and adequate turning and tilt space;
  • Any permits, council approvals, road closures or traffic management required;
  • A responsible adult present at the agreed delivery time to accept and direct placement.

If our carrier attends and delivery cannot be completed safely or lawfully due to site conditions, access, or your absence, a failed delivery fee and re-delivery charges will apply.

We are not responsible for damage to driveways, kerbs, lawns, paving, underground services or other property caused during delivery where access was directed or approved by you.

Placement of a Container on your property may require council approval. Obtaining any necessary approval is your responsibility.

12. International Export

We export Containers from Australia to destinations including Europe, the United States, Canada and Asia.

  • Export Orders are supplied on the Incoterm agreed in writing in your Quote (for example EXW, FOB, CFR or CIF, Incoterms® 2020). The Incoterm determines when cost and risk transfer to you.
  • Unless your Quote expressly states otherwise, import duties, taxes, customs charges, quarantine fees, demurrage and destination port charges are your responsibility.
  • You are responsible for ensuring the Goods may lawfully be imported into the destination country and for obtaining any import permits required.
  • Sailing schedules, transit times and vessel availability are controlled by shipping lines and are estimates only.
  • We will not export where doing so would breach Australian export controls, sanctions laws, or the laws of the destination country.

Where a Container is sold for sea cargo use, it will be supplied as Cargo Worthy and, where required, with a valid CSC plate. Containers sold as Wind & Water Tight or As-Is are not certified for sea cargo.

13. Modifications & Custom Work

Where you order modifications (such as doors, windows, ventilation, insulation, electrical fit-outs, offices, cabins or pools):

  • Work commences only after your written approval of the specification and receipt of the required deposit.
  • Custom-modified Goods are made to your order and are not returnable or refundable for change of mind.
  • Changes requested after work has commenced may incur additional charges and delay completion.
  • Modified Containers may not retain Cargo Worthy certification and may no longer be suitable for sea freight.
  • Electrical, plumbing and structural works may require certification, engineering sign-off or council approval in your jurisdiction. Obtaining these is your responsibility unless expressly agreed in writing.

14. Inspection & Acceptance

You (or your representative) should inspect the Goods on delivery or collection. Any claim for shortage, incorrect item, or visible damage must be notified to us in writing within forty-eight (48) hours of delivery, with photographs where possible.

Signing a delivery docket without noting damage may limit your ability to claim for visible transit damage. Nothing in this clause limits your rights under the Australian Consumer Law.

15. Cancellations & Returns

Because shipping containers are large, heavy industrial goods, returns carry significant cost. Accordingly:

  • Change of mind: we are not obliged to accept returns for change of mind. Where we agree to do so at our discretion, the Container must be in its original condition, and you will bear all return transport costs plus a restocking fee.
  • Custom or modified units: not returnable for change of mind.
  • Cancellation before dispatch: deposits are non-refundable where stock has been reserved, modification work commenced, or freight booked.
  • Faulty goods: your rights under the Australian Consumer Law apply in full — see clause 16.

16. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any right or remedy, guarantee, warranty or other term implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.

When assessing whether goods are of acceptable quality, regard is had to the nature of the goods, the price paid, and any description or grade under which they were sold — including that used containers are sold with expected wear consistent with their stated grade.

17. Warranties & Disclaimers

Subject to clause 16, and to the extent permitted by law:

  • New (one-trip) Containers are supplied with any manufacturer's warranty that applies; we pass through such warranties where we are able.
  • Used Containers are sold on the basis of their stated grade and are not warranted to be free of cosmetic defects, surface rust, dents or prior repairs.
  • We do not warrant that a Container will be suitable for any particular purpose unless we have confirmed that suitability in writing.
  • We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

18. Limitation of Liability

Subject to clause 16 and to the extent permitted by law:

  • Our total aggregate liability arising out of or in connection with an Order is limited, at our option, to the replacement or repair of the Goods, the supply of equivalent Goods, or the refund of the price paid for those Goods.
  • We are not liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of revenue, loss of opportunity, business interruption, or costs of substitute goods.
  • We are not liable for loss or damage arising from your failure to prepare the Delivery Point, from your directions as to placement, or from your use or modification of the Goods after risk has passed.

19. Indemnity

You indemnify ECS against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your negligence, your misuse of the Goods, unsafe conditions at the Delivery Point, or your failure to obtain any required permit or approval.

20. Force Majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including acts of God, extreme weather, fire, flood, pandemic, war, civil unrest, strikes, industrial action, port closures, vessel delays, shipping line schedule changes, container shortages, government action, sanctions, or failures of transport or communications infrastructure.

21. Intellectual Property

All content on this website — including text, images, logos, graphics, layout and design — is owned by or licensed to ECS and is protected by Australian and international copyright and trade mark laws.

You may view and print pages for your own personal or internal business use. You must not reproduce, republish, scrape, distribute, or commercially exploit any content without our prior written consent.

22. Website Use

You must not:

  • Use the website for any unlawful purpose or in breach of these Terms;
  • Attempt to gain unauthorised access to the website, its servers or any connected system;
  • Introduce viruses, malware or other harmful code;
  • Use automated systems to scrape, harvest or extract data from the website;
  • Interfere with the proper operation of the website or another user's use of it.

We may suspend or terminate your access to the website at any time for breach of these Terms.

23. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. By placing an Order you consent to your information being disclosed to delivery contractors, freight forwarders, customs brokers and payment processors as necessary to fulfil your Order.

24. Dispute Resolution

If a dispute arises, you agree to first contact us and attempt to resolve the matter in good faith. Please set out the nature of the dispute and the outcome you seek in writing.

If the dispute is not resolved within thirty (30) days, either party may pursue mediation or such other remedies as are available at law. Nothing in this clause prevents either party from seeking urgent injunctive relief.

25. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and ECS submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

26. General

  • Entire agreement. These Terms, together with your Quote and invoice, form the entire agreement between us and supersede any prior discussions or representations.
  • Severability. If any provision is found invalid or unenforceable, it is severed and the remaining provisions continue in full force.
  • Waiver. A failure or delay by us in enforcing a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights on notice to you.
  • Notices. Notices to us must be sent in writing to our address below.

27. Changes to These Terms

We may amend these Terms from time to time. The version published on this page at the time you place your Order governs that Order. We encourage you to review this page before each purchase.
